Terms & Conditions

Effective Date: 17 August 2025

This Terms of Service Agreement ("Agreement") is a legally binding agreement between you ("Client", "Employer", "Employee", or "User") and eeOH.co.uk ("eeOH", "we", "us", or "our"). By using our services, you agree to comply with the terms and conditions outlined below. If you do not agree with any of these terms, you must immediately stop using the service.

1. Services Provided

eeOH.co.uk offers online Self Help Guides, Occupational Health Reports and Fitness for Work Medicals primarily in the form of PDF documents. Reports are generated from information provided through a questionnaire filled out jointly by the Employee and Employer. These reports are intended to provide health and workplace advice, including recommendations for reasonable adjustments. Reports are reviewed and signed by Occupational Health Physicians (OHPs), who retain full responsibility for their content and recommendations. All services operate within a structured clinical governance framework, including regular audit, quality review, and physician oversight.

Service Details:

  • Self-Help Guide: This leaflet provides practical self-help guidance. Limited email support is available, typically up to three questions. For additional queries or case-specific advice, a personalised questionnaire-based report is recommended, as individual circumstances cannot be safely assessed without a full occupational health evaluation.

  • Personalised QB-OHR Report: After the employee and employer jointly fill out the questionnaire, the report will be created and reviewed by a qualified Occupational Health Physician (OHP) who takes full responsibility for its content and recommendations.

  • Report Delivery Options:

    • Prior Sight: The employee receives the report for review and approval before it is sent to the employer.

    • Same Sight: Both the employee and the employer receive the report at the same time.

  • E-mail Support: For any follow-up questions, e-mail support is available included in the fee (for Reports, limited for guides).

  • Consultations: For complex or serious cases, telephone or virtual consultations may be recommended in the report. These are optional and incur an additional fee.  For Fitness for Work Medicals these are all face-face at our Clinic at Dog Kennel Lane Surgery in Smethwick.

  • Service Availability: All questionnaires are screened by our OHPs, once approved a payment link will be sent via e-mail. Reports are typically delivered via e-mail within 7 days of receiving payment unless there is a delay for reasons beyond eeOH.co.uk's control (i.e. unforeseen circumstances beyond control). For Fitness for Work Medicals the certificate is generate same day provided there are no concerns.

  • What eeOH Can Do:

    • A. Direct OH Services (eeOH Directly Provides): Questionnaire-based assessments, mental health and stress screening, lifestyle and wellbeing evaluations, sickness absence and return-to-work planning, functional advice and phased work recommendations, reasonable adjustments and accommodation advice, HR advisory and compliance support, escalation for high-risk cases, and virtual consultations with a physician based on questionnaire and assessment data. Certain Fitness for Work Medicals in our Clinic.

    • B. Co-Ordinated/Outsourced Services (eeOH Facilitates or Interprets): Certain Safety-critical medicals beyond scope, vaccinations or immunisations, and rehabilitation or therapy outcomes.

  • Interpreter Responsibility: Employees requiring language support at any stage, whether completing the questionnaire, reviewing reports, or attending consultations are responsible for arranging a competent interpreter through their employer or a professional service. eeOH.co.uk does not provide interpreters and is not responsible for any errors arising from interpretation.

  • Clinical Governance: All services provided by eeOH.co.uk are delivered within a structured clinical governance framework, which includes regular review of policies, audits of report quality, and oversight by an Occupational Health Physician (OHP).

2. Fee Structure:

  • Self Help Guide: £50.

  • Personalised QB-OHR Report: £200. This is one-off charge including e-mail support.

  • Full Consultation: £300 if requested at outset or additional £100 if QB-OHR already completed (+£200 if Pre-Employment).

  • Pre-Employment Screening: £100 if Pre-Employment fit, £200 if adjustments required, £300 if consult required.

  • Fitness for Work Medical: £100 for consultation. Additional fees for investigations as outline on our services page.

  • Payment Method: Payments are due upfront, made via PayPal or Stripe to our designated Accounts. A payment link will be sent via e-mail when required. As work on reports typically begins promptly after payment, refunds cannot be offered.

  • Currency: All payments will be processed in GBP (£) only.

3. Limitations of the Service

The reports provided by eeOH.co.uk are based on the information given in the employee and employer's completed questionnaire. These reports are not substitutes for medical consultations and may not be suitable in isolation for highly complex or serious health issues.

Scope of the Report:

  • Medical Advice: QB-OHRs are based solely on the information provided in the employee and employer questionnaire. The Occupational Health Physician (OHP) cannot account for undisclosed or incomplete information.

  • Purpose and Intended Use: QB-OHRs provide early, practical guidance for workplace adjustments, timely decision-making, and preliminary occupational health assessment. They may also be used for pre-employment checks and ill-health retirement (IHR) considerations, but should not be treated as a full occupational health assessment.

  • Nature of Opinions: While we aim to give clear and practical guidance, many conclusions are expressed in terms of likelihood, probability, or best clinical judgement especially if no direct consultation has taken place.

  • Limitations and Further Consultation: Reports highlight areas that may require additional information or clarification. If more detailed, complex, or definitive opinions are needed—such as for certain pre-employment clearances, IHR decisions, or complex health issues—a further consultation with an OHP may be recommended to refine and clarify advice.

  • Not a Substitute for Urgent Advice: QB-OHRs provide occupational health guidance only and do not replace urgent or emergency medical advice.

  • Employer Responsibilities: Employers are responsible for providing accurate information in the questionnaires and for implementing reasonable adjustments or recommendations made in the reports. Employers must not misuse reports or apply them outside their intended purpose.

Report Accuracy:

  • Based on Information Provided: The quality and accuracy of the report depend entirely on the information provided in the questionnaire. eeOH.co.uk and its physicians are not responsible for errors or omissions in the report resulting from incomplete or inaccurate questionnaire submissions.

  • Factual Errors: If any factual errors are identified in the report, eeOH.co.uk will make reasonable efforts to correct them at no additional charge.

  • Disagreements with Report: If there are disagreements regarding the opinions or recommendations in the report, an addendum may be issued to address the issue, but eeOH.co.uk is not liable for any outcomes made by the employers or employees resulting from the opinions provided in the report.

4. Privacy Policy & GDPR Compliance

eeOH.co.uk is committed to protecting your privacy and ensuring compliance with General Data Protection Regulation (GDPR) and the Data Protection Act 2018.

Data Collection:

  • Personal Data: We collect personal information such as the employee's name, contact details, and health information through the completed questionnaire. This data is used solely to generate the Occupational Health Report.

  • Health Data: Health-related data, which may include sensitive medical information, is collected only with explicit consent. This data will be treated with the highest level of confidentiality.

Data Use:

  • Purpose of Data Use: Personal and health data will only be used to generate reports, provide email support, and fulfil any services you have requested. We will never use your personal data for any other purpose without your explicit consent.

  • Anonymised AI Processing: Any data processed by AI tools will be anonymised to ensure that no personally identifiable information is stored or used during the AI processing phase.

Data Security:

  • Encryption & Secure Delivery: All data is encrypted in transit (HTTPS) and at rest. Reports are securely sent either as a password protected file on e-mail or transmitted more securely if desired via the Egress system, ensuring confidential delivery to employees and employers.

  • Secure Storage: Data will be stored in compliance with GDPR and UK Data Protection Laws. Only authorised personnel at eeOH.co.uk will have access to the data necessary for the creation of the report.

Rights of Data Subjects:

  • Access: Employees and employers have the right to access any personal data held by eeOH.co.uk. You may request a copy of the data we hold by contacting us at support@eeoh.co.uk.

  • Rectification & Erasure: You have the right to request corrections to any inaccurate data and to request the deletion of your personal data at any time, subject to our legal obligations to retain certain information.

  • Data Retention: We will retain occupational health reports and related data for a minimum of 6 years, in line with standard occupational health practice, unless a longer retention period is legally required.

Information Governance Audits:

  • eeOH.co.uk conducts periodic audits of information governance and data security to ensure compliance with GDPR and SEQOHS standards. This includes regular review of IT security measures and a business continuity plan to maintain service resilience in the event of technical or operational disruption.

5. Confidentiality and Non-Disclosure Agreement (NDA)

eeOH.co.uk is committed to maintaining the confidentiality of your health and personal information in accordance with the UK’s Data Protection Laws, General Medical Council (GMC) and Faculty of Occupational Medicine (FOM) guidelines.

Confidential Information:

  • Health Information: All health-related data provided by the employee and employer will be considered confidential and will only be shared with authorised personnel at eeOH.co.uk and the Occupational Health Physician responsible for reviewing and signing the report. Employees consent to sharing relevant report information with the employer.

  • Exceptions: Confidentiality may be breached if required by law, by court order, or to prevent serious harm, and we will notify the employee and employer unless legally prohibited.

Non-Disclosure:

  • Third-Party Providers: If external parties (such as other virtual consultation providers or additional services) are involved/advised, they will be required to sign a non-disclosure agreement (NDA) to protect the confidentiality of the personal data and health information.

  • Disclosure Restrictions: eeOH.co.uk will not disclose any personal data or health-related information to third parties without the explicit consent of the employee or employer unless required by law.

6. Ethical Guidelines and Legal Regulations

eeOH.co.uk adheres to a strict ethical code and complies with all relevant UK laws, including:

General Medical Council (GMC) Guidelines:

  • Good Medical Practice: Occupational Health Physicians must provide impartial, evidence-based advice, maintaining a duty of care to the employee while balancing the needs of the employer.

  • Informed Consent: Employees must be fully informed about the data collected and the purpose of its use before consenting to the creation of their report.

Occupational Health Standards:

  • eeOH.co.uk follows the guidelines of the Society of Occupational Medicine (SOM) and the Faculty of Occupational Medicine (FOM), which emphasise fairness, impartiality, and professionalism in all medical and occupational health assessments and advice. All Occupational Health Physicians are fully registered with the General Medical Council (GMC) and maintain annual appraisal, revalidation, and continuous professional development (CPD) in accordance with Faculty of Occupational Medicine (FOM) requirements. Any subcontracted associates must demonstrate professional registration, insurance, and CPD as a condition of engagement.

  • Health and Safety Executive (HSE): The recommendations in the report are designed to align with HSE guidelines for workplace health, safety, and reasonable adjustments for employees with health conditions.

7. Payment Terms and Cancellations

  • Payment Methods: Payments are due upfront via PayPal or Stripe to our designated accounts. A payment link will be sent via e-mail when required. Reports will only be issued once payment is successfully received; if payment fails or is disputed, delivery may be delayed or withheld until resolved.

  • Refund Policy: Please note that refunds are not available once any clinical work has been started.  Reports are prepared quite rapidly after payment. We therefore kindly ask that clients are sure they wish to proceed before making payment. If no work has started a full refund will be issued. For Face-Face Fitness for Work Medicals; can be cancelled and refunded provided 48 hours notice is given.

8. Consultations (Optional)

Virtual consultations may be offered for cases that require more in-depth evaluation.

  • Consultation Limitations: Telephone/Virtual consultations are intended for cases that require additional clarification. In the case of complex or serious health issues, the consultation will provide general advice, and further in-person consultations may be necessary. Fitness for Work Medicals must be conducted at our clinic.

  • Referral to Third-Party Providers: For certain additional services beyond scope (e.g. certain safety critical medicals), eeOH.co.uk can provide preliminary reports if desired for guidance but may then refer to external providers. You will be referred to one of these external providers, and their terms of service will apply.

9. Third-Party Content, Referrals, and Subcontractors

  • User-Generated Content: From time to time, users may post comments (for example, on blogs or forums). These views belong solely to the individual author and do not represent eeOH.co.uk. While we encourage respectful discussion, we are not responsible for any comments or opinions made by others.

  • Referrals to Third Parties: Occasionally, we may suggest or signpost you to external services such as counselling, therapy, HR, legal, or medical providers. Any referral is made in good faith, with the intention of helping you find additional support. However, these providers are completely independent, and eeOH.co.uk cannot accept responsibility for the quality, accuracy, or outcomes of their services. Any arrangements you make with them are entirely between you and the third party.

  • Subcontractors and Associates: At times, we may work with trusted subcontractors or associates to help deliver parts of our service, particularly during high referral volumes.. Each operates in their own professional capacity and must evidence professional registration, insurance, and CPD as verified by eeOH.co.uk. While we choose them carefully, eeOH.co.uk is not liable for any errors, omissions, or negligence on their part.

  • Limitation of Liability: In short, while we aim to provide safe, high-quality services and referrals, eeOH.co.uk cannot be held legally responsible for (i) user-generated content, (ii) the actions or services of independent third parties, or (iii) the conduct of subcontractors engaged in their own capacity.

10. Governing Law, Complaints, and Dispute Resolution​

  • Governing Law: This Agreement is governed by the laws of England and Wales.

  • Informal Resolution: We encourage clients and employees to address concerns informally by contacting the relevant member of our Occupational Health team directly. This approach often leads to a swift and amicable resolution.

  • Formal Complaints Procedure: If the issue remains unresolved after informal discussions, a formal complaint can be submitted in writing to: Occupational Health Manager, Email: support@eeoh.co.uk. Please include the following details in your complaint: A clear and detailed description of the issue. Relevant dates and any supporting documentation. Desired outcome or resolution.

  • Acknowledgment and Response Times: Upon receipt of your complaint, we will: Acknowledge receipt within 5 working days. Provide a full response within 20 working days. If more time is required to investigate, we will inform you of the delay and provide an estimated timeline.

  • Escalation: If you are not satisfied with the outcome of your complaint, you may escalate the matter to following. Please note that escalation should occur after our internal complaints process has been completed.: 

    • General Medical Council (GMC) - For concerns about the conduct or clinical care of a registered doctor. Website: www.gmc-uk.org.

    • Information Commissioner’s Office (ICO) - For complaints about how your personal or health data has been handled. Website: www.ico.org.uk.

  • Professional Indemnity: eeOH.co.uk maintains professional indemnity insurance for all services provided. Evidence can be accessed on the homepage.
